GFA, BNI set for a showdown

The Ghana Football Association (GFA) has expressed surprise at a request by the Bureau of National Investigation (BNI) that it makes available documents on friendly matches, sponsorship contracts and FIFA prize monies for 2006, 2010 and 2014 World Cup tournaments.

Also being requested from the FA by the BNI are documents to show how the prize monies were disbursed.

But an unimpeachable FA source told the Graphic Sports at the weekend that the association would soon challenge the legal basis for the demands in court.

According to the source, the White Paper on the report of the Presidential Commission of Inquiry asked the BNI to investigate stated issues from the report but “what they are seeking to do is ultra vires”.

The source pointed out that “even for issues in the White Paper, the BNI can’t do anything yet” since “that will be a flagrant breach of provisions on human rights in the constitution”.

Explaining, the source held that “the constitution stipulates that the report of the commission crystallises into a judgement of the High Court six months after publication. Persons affected by the report have three months to appeal against any adverse findings.

That takes us to December 2015 and March 2016. By their action they are trying to truncate the rights of persons affected by the report”.

Given the above knowledge, the FA source wondered where the BNI instructions were coming from, but did not mince words stressing that the association would challenge it in court.

The source indicated that the FA’s response to the BNI request would manifest by close of day today.

The Graphic Sports, however, had not been able to make contact with the BNI.
