The Electoral Commission (EC) has explained that Dr Zanetor Rawlings was not a registered voter per their records.
The eligibility of Dr Rawlings as the National Democratic Congress (NDC) Parliamentary nominee for Klottey Korle constituency in Greater Accra is being challenged in court by Nii Armah Ashietey.
Nii Ashietey, the incumbent Member of Parliament for the constituency who lost the November 2015 primary to Dr Rawlings is of the view that her election was unlawful since she was not a registered voter.
He has consequently filed a suit at the Accra High Court challenging her eligibility. Joined in the suit is the Electoral Commission.
He is asking the court to subpoena the Electoral Commission to provide information on Dr Rawlings’ voter status.
A letter written by the EC Chairperson, Mrs Charlotte Osei to a lawyer, Mr Thaddeus Sory, instructing him to represent the Commission in court reads in part: “We write to instruct you to conduct the above suit on our behalf.”
“We have received letters from the lawyers of the plaintiff [Nii Armah Ashietey] in the matter requesting information on the status of Dr Zanetor Agyeman-Rawlings as a registered voter as well as a subpoena duces Tecum served on the Commission in respect thereof.”
“Our records confirm that she is not on the Commission’s register as a registered voter.”
“Please take note and take appropriate steps to strike out the suit against the Commission because it appears clearly from the processes served on the Commission, that the only reason the Commission has been made party to the suit, is because the plaintiff desires information on the status of Dr Zanetor Agyeman-Rawlings as a registered voter, which by virtue of the subpoena duces Tecum we would have been bound to disclose to the court anyway.”
