The Supreme Court has by a majority decision dismissed the suit against the mandate of the Constitutional Review Implementation committee by a US-based Ghanaian lawyer, Professor Stephen Kwaku.
The law Professor filed a suit at the Supreme Court, seeking to nullify the constitution review process.
He contended that apart from parliament, the Constitution Review Implementation Committee has no powers to schedule a referendum for an amendment of the constitution.
But the Supreme Court, by a 5 to 2 majority decision, threw out the motion Wednesday, Starr News’ Wilberforce Asare who was in court reported.
The Implementation Committee, chaired by Professor E.V.O Dankwa, was sworn into office by Justice Dennis Agyei, an Appeal Court Judge in 2012.
Other members of the committee are Dr Kunbour, Ex Officio member, Mrs Estelle Appiah, Dr Gheysika Adombire Agambila and Mr Bede A. Ziedeng.
The committee has been tasked to develop and report on the public reactions to the Government White Paper and the Constitution amendment bills for both the entrenched and non-entrenched provisions of the constitution.
