Election petition: Supreme Court refuses Tsatsu Tsikata’s review application

The Supreme Court has dismissed former President John Dramani Mahama’s application which was asking the court to review its decision that disallowed him from asking the Electoral Commission (EC) 12 questions in the 2020 presidential election petition.

Mr Mahama, the National Democratic Congress (NDC) presidential candidate for the 2020 through his lawyers, had filed for review of the court’s earlier decision on the request to ask the first respondent, Chairperson of the Electoral Commission, Jean Adukwei Mensa certain questions termed interrogatories.

Lead Counsel for the petitioner, Tsatsu Tsikata had argued that the interrogatories are relevant as it would help the apex court determine the authenticity of the result that was declared on December 9, 2020, by the EC.

Again, he explained that order 22 under C.1 47 can still be applied since it will not affect the 42-day timeline the court wants to meet under the C.I 99.

In his view, the decision by the Court to dismiss the application was “an error” hence, necessary for the court to review its ruling.

He said granting the interrogatories will be critical in helping the Apex Court determine the authenticity of the results declared by the EC on December 9, 2020.

The judges however maintained they are strictly bound by C.I. 99 and therefore will not apply order 22 which is on interrogatories under the C.I. 47.
